Who owns the land directly on either side of train tracks? I ask because my property borders some train tracks and I have direct access to the area between my property and where the tracks are. I was thinking of going out and riding along side the tracks, but was unsure if this was allowed or not. Thanks.

The tracks and area on either side of the tracks are known as the right-of-way. The right-of-way is owned by the railroad. Since this is private property, you are trespassing if you are on or near the tracks. Walking on or along the tracks or crossing the tracks at unauthorized locations can result in serious injury or even death.

Trespass Laws

According to the Criminal Justice Code of New Jersey, Title 2C:18-3, Criminal Trespass, it is against the law to be on the railroad tracks. Since railroad tracks are private property, you can be arrested for trespassing (walking, taking a shortcut) on them. If convicted of this offense, you will be subject to a fine on not less than $100 and/or imprisonment.

I would imagine it is the same in all states....

My dad is actually a rail road cop in Detroit. Works for CN North America, formerly Grand Trunk. Most of the local PD lets the RR take care of their own policing, so I doubt you would have any problems. The tracks are probably Union Pacific in this area, and I have no idea if they have their own policing agency or not.

If anything you would just maybe get yelled at. I wouldn't worry about fines or jail time.

The rr owns the property in question. They do police it (Rarely) however the Reno pd or the WCSO gets called out (Depending on who's jurisdiction it is) anytime someone is around the tracks. it is posted private property and you can be cited. plus its not too smart to play on rr tracks.:no:

Jibs I would be careful playing on or around the train tracks. I don't want to see a report on the six oclock news about a Subie that high centered on the railroad tracks and got hit by an amtrak train. :rolling:

Yeah you might. But then you'd see video of me holding a beer in the background waving and laughing my ass off at what happens when a train takes a subie out.:rolling: :thumbsup:

PS Crossing tracks you have to have Min 33's to clear the housing. I wont tell you how I know that.:no:

And If you interfere with the progress of a train They will prosecute. I have tracks going through my building, and most tracks out here are UP but some are CN.

Subes with IFS/IRS could prolly clear tracks with smaller than 33's. Our diffs dont hang down as low as you solid axle guys.

I still wouldnt wanna try it. Train tracks arent anything to mess with.
