Well, someone has to use facts in this conversation so I guess I will:
First off, the FDA does not regulate the Restaurant industry (Although their Food Code is used as a guideline for most local agencies):
Nor do they regulate Meat or Poultry:
And the FSIS referenced above focuses on the plants that produce and distribute products.
The USDA does not regulate Restaurants either.
The National Association of Restaurants does however provide guidelines for it's members, but it is a private organization and although they work closely with the Gov on restaurant issues, they are not a gov agency.
Restaurants are the domain of local health inspectors for each city and county the restaurants reside in. So in order to get one of these "Golden Ticket" waivers, Denny's would have to contact each of these local agencies for their 1600+ locations. am pretty certain they would not undertake that, and more certain that most of these agencies should they be contacted with a request like that would most likely not approve it.
Washoe county will not let you give away food for free within a commercial establishment without a permit, and in order to get a permit you must follow
these guidelines, which focus a lot on safe food handling, storage and ensuring that your food comes from approved facilities.
Additionally, no food other than baby formula is required to have an "Expiration Date"
So technically a restaurant cannot serve "expired" food (well, I guess all meat products can be considered expired in some ways since an animal had to expire for the meat to be produced...but I digress...back on point), and any restaurant which knowingly served spoiled food would open themselves to a lot of legal liability.
Also, a fairly exhaustive internet search turned up no reference to "Free Grand Slams" in April of last year, only February of 2009 and 2010.
So in conclusion, there is a ton of information that would go against a lot of your claims and a fair amount of data that would make it very unlikely that Denny's would participate in the practices you outlined.
I certainly am not saying you are wrong........but I certainly am of the opinion that you may have a few of your facts off.
